Donor Terms and Conditions

These terms apply to donations made through Fundraisy. By making a donation, you agree to them.

These Donor Terms and Conditions apply when you make a donation through Fundraisy, including donations made via fundraising pages created by organisations on our platform. They should be read alongside our Privacy Policy and Website Terms of Use.

If you don’t agree with these terms, please don’t make a donation through Fundraisy.

Who we are

Fundraisy.co.uk is operated by Fundraisy, the trading name of Tylney Ltd (“we”, “us”, “our”). We are registered in England and Wales (company number 15279589).

Definitions

In these terms:

  • Platform means the Fundraisy website and any related services we provide.
  • Donor means a person making a donation through Fundraisy.
  • Organisation means the person or group raising funds using Fundraisy.
  • Donation means the amount you choose to give to an Organisation through Fundraisy.
  • Payment Provider means our third-party payment processor (currently Stripe).
  • Gift Aid means the UK tax relief scheme administered by HMRC which may increase eligible donations.
  • Tip means an optional voluntary amount a donor may choose to give to support Fundraisy.

1. Your donation

Donations made through Fundraisy are voluntary. When you submit a donation, you authorise us and our Payment Provider to process your payment.

2. Payment processing

Payments are processed securely by our Payment Provider. Fundraisy does not store your card details.

You may be asked for an email address as part of the payment process (for example, to send a payment confirmation and to help prevent fraud).

3. Use of funds

Donations are collected for the Organisation named on the fundraising page and will be used for the fundraising purpose described there.

If more funds are raised than required, or if the stated purpose changes, the Organisation may use the funds for closely related charitable or community purposes, unless the fundraising page states otherwise.

4. Refunds and errors

Donations are normally non-refundable. However, refunds may be available in limited circumstances, such as where a donation was made in error (for example, an incorrect amount) or where required by law.

If you believe a donation was made in error, please contact the Organisation as soon as possible. If needed, you may also contact Fundraisy at support@fundraisy.co.uk.

5. Gift Aid

If you choose to add Gift Aid to your donation, you confirm that:

  • you are a UK taxpayer; and
  • you have paid enough Income Tax and/or Capital Gains Tax in the current tax year to cover the amount of Gift Aid claimed on your donation.

You are responsible for ensuring you are eligible to claim Gift Aid. If you are unsure, you should check the HMRC rules or seek advice.

If you select Gift Aid, the Organisation may request additional information (such as your full name and home address) to meet HMRC requirements.

6. Tips to support Fundraisy (optional)

Donors may be given the option to leave a voluntary Tip to support Fundraisy. Any Tip is entirely optional and does not form part of your Donation to the Organisation.

Tips are paid to Fundraisy and remain the property of Fundraisy.

7. Communications and updates

You may be given the option to receive updates from the Organisation. If you opt in, your contact details will be used by the Organisation for that purpose only, and you can unsubscribe at any time.

8. Data protection

We are committed to protecting personal data. Our use of personal information is explained in our Privacy Policy.

Fundraisy is registered with the Information Commissioner’s Office (ZB659322).

9. Limitation of liability

Fundraisy provides the platform used to collect donations. To the fullest extent allowed by law, we are not liable for any loss or damage arising from your donation, including where an Organisation changes how it uses funds within the scope described on its page.

Nothing in these terms limits liability where it cannot legally be limited (for example, for death or personal injury caused by negligence, or fraud).

10. Changes to these terms

We may update these Donor Terms and Conditions from time to time. Changes take effect as soon as they are posted on this page. If you continue to make donations through Fundraisy after an update, you’re agreeing to the updated terms.
